Abstract [sv]

Barnäktenskap är något som sker i stora delar av världen. Under flyktingströmmen 2015–2016 kom många barn till Sverige från andra länder. En del av dessa barn var gifta vilket bidrog till en debatt kring hur Sverige skulle hantera ärenden rörande gifta barn. Slutligen ledde detta till en lagändring 1 januari 2019 som medförde att utländska barnäktenskap inte längre erkänns i Sverige. Lagändringen mynnade ut i en omfattande diskussion gällande vad lagen skulle innebära i praktiken. 

Kvalitativa intervjuer har genomförts med totalt nio personer från Migrationsverket och socialtjänsten som i sin yrkesroll på något sätt har mött barn som uppges vara gifta. Genom deras tankar och berättelser kring ämnet har tre teman identifierats som utmärkande när det gäller handläggningen av barn som uppges vara gifta. Resultatet visar att handläggare i stor grad följer något de kallar ”magkänsla” när det gäller identifieringen av gifta barn och de anser också att kulturella skillnader kan bidra till svårigheter i beslutsfattandet. Handläggarna beskriver att de har ett stort handlingsutrymme i ärendena, men måste också ta hänsyn till riktlinjer och lagar.

Abstract [en]

Child marriage is a worldwide phenomenon. During 2015–2016 Sweden received a large amount of refugee children. Some of these children were married, which lead to a debate on how Sweden were going to handle child marriage. Eventually this led to Sweden establishing an amendment January 1th 2019 to no longer allow foreign child marriages. With this revision came a wide discussion whether it is the right way to counteract child marriage or not, and if the law would have the desired outcomes. 

Qualitative interviews have been conducted with a total of nine administrative officers from the Swedish immigration agency and Social Workers at social service offices. Through their thoughts and stories on the subject about child marriage the thesis will highlight three topics that stand out in the process of identifying and working with children who declares to be married in Sweden. The result show that the administrative officers often follow their intuition concerning the identification of the children and their marital status. Furthermore, they find cultural difference as something challenging when they must decide in these matters. The workers have a great deal of worker’s discretion but are at the same time required to follow guidelines and Swedish law in their daily work.
